The 258th Judicial District’s standing order on default judgments (Judge Travis E. Kitchens, Jr., eff. Jan. 1, 2023): after the answer period, the plaintiff files a Motion for Default Judgment requesting a hearing, with the defendant’s last known address; the court sets a hearing and sends the defendant notice; if the defendant fails to appear, the court will consider granting the motion without plaintiff’s counsel appearing; and if the defendant appears, the appearance is treated as an answer, the default motion is denied, and the case proceeds under the TRCP.
Texas > Polk County > the 258th and 411th District Courts (and, for the family standing order, the Polk County Court at Law). A three-county instrument of the 258th/411th District Courts registered once under Polk (TOPICs doc 1040); this Polk row reflects the order’s own stated three-county scope.
"After the appropriate time has transpired for the Defendant to file an answer, the plaintiff shall file a Motion for Default Judgment requesting a default judgment and shall request... a hearing on the Motion for Default Judgment, together with the Defendant’s last known address. The Court will then set a hearing on the Motion for Default Judgment and send notice to the Defendant of such court hearing. If the Defendant fails to appear for the hearing... then the Court will consider granting of the Motion for Default Judgment without the necessity of the Plaintiff’s counsel appearing. If the Defendant appears in Court, the appearance will be considered the answer and the Motion for Default Judgment will be denied and the case proceed according to the Texas Rules of Civil Procedure." Signed Travis E. Kitchens, Jr., Judge, 258th Judicial District (Polk, San Jacinto and Trinity Counties); effective January 1, 2023.
Reviewer note: Read in full through the vision lane from the Polk registration (doc 1040); the instrument names Polk, San Jacinto and Trinity Counties. Composed as one row per served county to reflect that stated scope. Composed benchpath-ajr2-trio. Applicability 2026-09-09 (fix program 2026-09-09, Phase 5, audit M7): specific -> universal — the row binds every court in its state/circuit/county scope and names no court, judge or division.
