The 258th Judicial District’s standing order on default judgments (Judge Travis E. Kitchens, Jr., eff. Jan. 1, 2023): after the answer period, the plaintiff files a Motion for Default Judgment requesting a hearing, with the defendant’s last known address; the court sets a hearing and sends the defendant notice; if the defendant fails to appear, the court will consider granting the motion without plaintiff’s counsel appearing; and if the defendant appears, the appearance is treated as an answer, the default motion is denied, and the case proceeds under the TRCP.

"After the appropriate time has transpired for the Defendant to file an answer, the plaintiff shall file a Motion for Default Judgment requesting a default judgment and shall request... a hearing on the Motion for Default Judgment, together with the Defendant’s last known address. The Court will then set a hearing on the Motion for Default Judgment and send notice to the Defendant of such court hearing. If the Defendant fails to appear for the hearing... then the Court will consider granting of the Motion for Default Judgment without the necessity of the Plaintiff’s counsel appearing. If the Defendant appears in Court, the appearance will be considered the answer and the Motion for Default Judgment will be denied and the case proceed according to the Texas Rules of Civil Procedure."
