The six rules of administration adopted by a majority of Victoria County's justices of the peace under Government Code § 27.061: the nearest justice temporarily serves a vacant or absent precinct; justices may exchange benches or hear each other's cases on request without an order; any justice may sign citations, warrants, writs and process for an absent justice; the rules are kept at each office and posted on the county website; effective January 1, 2012; amendable by majority vote.

WHEREAS, the Texas Legislature had amended the Texas Government Code under House Bill 79 (82-1) to add section 27.061 requiring Justices of the Peace in each county to adopt, by majority vote, local rules of administration, NOW THEREFORE, we the undersigned Justices of the Peace, being a majority of the Justices of the Peace in Victoria County, Texas, do hereby adopt the following Rules of Administration which shall govern the administration of the Justice Courts in Victoria County, Texas: RULES OF ADMINISTRATION Rule 1. VACANCY OR ABSENCE. If the office of any justice of the peace is vacant in a precinct or if the justice is absent or unable or unwilling to perform his duties, the nearest justice in the county may temporarily perform the duties of the office. Source: Texas Government Code, section 27.052 Rule 2. EXCHANGE OF BENCHES. A justice of the peace may hold court, exchange benches, or hear cases for any other justice at the request of that justice without the necessity of an order. Source: Texas Government Code, section 27.054 Rule 3. CITATIONS, WARRANTS, WRITS, AND PROCESSES. If a justice of the peace is absent or unavailable to sign citations, warrants, writs, and other processes of court any other justice of the peace may sign such citations, warrants, writs, and other processes for the absent or unavailable Justice. Rule 4. VIEWING AND PUBLICATION. These Rules of Administration shall be available to the public at the offices of each Justice of the Peace. These Rules of Administration shall also be posted on the webpage for the Justice Courts on the official website for Victoria County, Texas. Rule 5. EFFECTIVE DATE. These Rules of Administration shall be take effect January 1, 2012. Rule 6. AMENDMENTS. These Rules of Administration may be amended by the majority vote of the Justice of the Peace in Victoria County, Texas.
