Standing Order for Discovery, Disclosure and Protection of Criminal History Record Information, Medical Records Covered by HIPAA & the Disclosure & Dissemination of Presentence Investigation Reports in Criminal Cases, entered by the judges of the District Courts in Williamson County to facilitate the exchange and disclosure of discoverable information in the possession of the Williamson County District Attorney's Office under Article 39.14 of the Texas Code of Criminal Procedure; it applies only to felony criminal cases filed in Williamson County. STANDING ORDER: Criminal History Record Information — to comply with Article 39.14, the District Courts authorize the District Attorney's Office to disclose to the attorney of record for the defendant the criminal history record information of the defendant and any potential witnesses contained in the District Attorney's file (disclosure by court order is authorized under Texas Government Code section 411.084(2)(D)), and defense attorneys receiving it must comply with Chapter 411 of the Government Code and Article 39.14 regarding its use and dissemination. STANDING ORDER: Protected Health Information Covered by HIPAA — the District Courts authorize the District Attorney's Office to disclose to defense counsel any medical records, including protected health information, contained in the file and related and material to the felony case, and defense attorneys receiving it must comply with HIPAA, the related privacy rules, the Texas Medical Privacy Act, and Article 39.14 regarding its use and dissemination. Further provisions govern the disclosure and dissemination of presentence investigation reports.
