STANDING ORDER FOR ZOOM HEARINGS The Court enters this Standing Order for Zoom and vacates the prior Standing Order for Hearings No. 4. The Court, upon a finding of good cause, may conduct hearings and bench trials by Zoom. UPON REQUEST FOR SETTING, COUNSEL SHALL INFORM THE COURT IN WRITING AS TO WHETHER A ZOOM HEARING IS REQUESTED and the reason, they believe is good cause to have Zoom. The Court’s Zoom channel on YouTube is 121st District Court. In order to conduct a visual Zoom hearing, each participant must have a computer or smart phone with webcam capabilities and an email address for notification from the Court. Each attorney or pro se party shall prior to the hearing conduct a trial run of their witnesses Zoom capabilities. It is FURTHER ORDERED that, each attorney or pro se party shall notify the Court of their email address, not later than 3 business days prior to the hearing date. If there is not confirmed contact by the Court as Ordered herein or, if the party upon confirmation of contact information fails to appear by Zoom or phone, at the date and time of the hearing, the Court will conduct the hearing by Zoom and the party will be found to be in default. It is FURTHER ORDERED that each party submit to the court it’s Exhibits by email to jadidway@terrycounty.org; in the subject line include the style of the case and cause number; pre-number each exhibit and attach separately to the email; and, all exhibits shall be in one email. If an exhibit cannot be submitted by email, it is to be delivered to the Court prior to the hearing in person or by Dropbox. All exhibit shall be provided by 3:00 p.m. on the day before the hearing. Prior to the commencement of any hearing or trial, the attorneys shall confer to identify those exhibits to which admissibility may be stipulated. All exhibits not objected to by opposing counsel, shall be admitted into evidence as a first order of business at the hearing/trial. It is FURTHER ORDERED that the District Clerk shall refer to this Order in and serve the Order, with any precept for any Zoom hearing noticed by the Clerk. NOTE: All participants shall adhere to proper dress and decorum for all virtual appearances.
