If a city, county, state or public office, other than a branch office, is closed for the whole of a day, that day is a holiday for computing time under sections 12 and 12a.
For any act provided by law, time is computed by excluding the first day and including the last, unless the last day is a holiday, in which case it is also excluded.
Where a law requires an act no later than a specified number of days before a hearing, the last day is found by counting backward from the hearing date, excluding the day of the hearing as section 12 provides; days added for a particular method of service are counted backward from that day.
Electronic service of a document that may be served by mail, express mail, overnight delivery or fax is complete when the document, or the notice of its service, is sent, and a period running after service is extended two court days, except for a notice of intention to move for new trial, a notice of intention to move to vacate judgment under section 663a, or a notice of appeal; the extension applies only absent a specific exception. A document served electronically on a court day is deemed served that day, and one served on a day that is not a court day is deemed served on the next court day.
Unless all parties stipulate otherwise, within 60 days of any party's demand each party that has appeared — including the demanding party — must serve an initial disclosure identifying the persons likely to have discoverable information, the documents, electronically stored information and things it may use or that are relevant, and the insurance and indemnity agreements that may satisfy a judgment; disclosures are verified, supplemental demands are limited to two before and one after the initial trial setting absent leave, and the duty is enforceable by motion. The section does not apply to unlawful detainer, small claims, Family Code, Probate Code or preference cases, nor to a party not represented by counsel, and the current version applies to actions filed on or after January 1, 2024.
Every full day the Government Code (section 6700) designates as a holiday, including Thanksgiving Day, is a judicial holiday, except Lunar New Year, Diwali, Genocide Remembrance Day (April 24), Admission Day (September 9), Columbus Day and any day appointed by the President but not the Governor. Every Saturday and the day after Thanksgiving are judicial holidays, and the Judicial Council may designate another day when a judicial holiday falls on a Saturday or Sunday.
At least one party demanding a jury on each side of a civil case must pay a nonrefundable $150 fee, due on or before the initial case management conference — at least five days before trial in unlawful detainer actions, and by the statute's alternative dates where no conference is scheduled or the party appeared late; the parties demanding a jury deposit each day's jury fees and mileage from the second day of trial; a party waives jury by failing to appear at trial, by written or oral consent, by failing to announce that a jury is required when the case is first set for trial or within five days after notice of setting, by failing to pay the fee, or by failing to make the daily deposits; the court may relieve a waiver on just terms.
If the last day to perform an act provided or required by law is a holiday, the period extends to and includes the next day that is not a holiday. For this purpose 'holiday' means all day on Saturdays, the holidays specified in section 135 and, to the extent section 12b provides, the days that section requires to be treated as holidays. The rule applies to every provision of law that requires an act on a particular day or within a specified period.
Unless otherwise ordered or specifically provided by law, moving and supporting papers must be served and filed at least 16 court days before the hearing — increased by 5, 10, 12 or 20 calendar days for service by mail depending on the address, and by two calendar days for fax, express-mail or overnight service; opposition papers are due at least nine court days and reply papers at least five court days before the hearing, and both must be served by a method reasonably calculated to deliver them by the close of the next business day after filing. The court may prescribe a shorter time.
Service by mail is complete at deposit, and a period running after service is extended five calendar days within California, 10 outside California but within the United States, 12 for the Secretary of State's address confidentiality program and 20 outside the United States; service by Express Mail or overnight delivery extends it two court days. Neither extension applies to a notice of intention to move for new trial, a notice of intention to move to vacate judgment under section 663a, or a notice of appeal, and each applies only absent a specific exception.
A motion for summary judgment may be made 60 days after the general appearance of each party it is directed against; notice and supporting papers must be served at least 81 days before the hearing (increased for service by mail or overnight delivery), the motion must be heard no later than 30 days before trial unless the court orders otherwise for good cause, the opposition is due not less than 20 days and the reply not less than 11 days before the hearing, each side files a separate statement of material facts, and a party may bring only one summary judgment motion against an adverse party without leave. Sections 1005 and 1013 do not extend these periods, except section 1005(c) on the method of serving opposition and reply papers; a party who shows that essential facts may exist but cannot yet be presented may obtain a denial or continuance.
The summons directs the defendant to file a written response to the complaint within 30 days after service, warns that default may be entered on the plaintiff's application otherwise, and carries the statutory notices in English and Spanish; a summons in a Judicial Council-approved form complies. As amended effective January 1, 2026, the section also directs the Judicial Council to create, by January 1, 2027, a mandatory multilingual summons form for residential unlawful detainer actions.
In an unlawful detainer action the summons follows section 412.20, except that the defendant's response is due within 10 days — excluding Saturdays, Sundays and other judicial holidays — after the complaint is served, with five additional court days when service is completed by mail or in person through the Secretary of State's address confidentiality program; the summons is otherwise issued, served and returned as in a civil action.
If the defendant appears, trial must be held not later than the 20th day after the request to set the trial is made, with judgment entered and, if the plaintiff prevails, a writ of execution issued immediately on request; the period may be extended by agreement of all parties, and otherwise only after a hearing under subdivision (c) at which the court may order rent paid into court or escrow; if a court-ordered payment is missed, trial is held within 15 days of the missed due date.
