Unlock free →You must first file a motion for the continuance of a hearing with the Clerk of Court. Do not call chambers and leave a message with your request as a filed motion is mandatory. The motion must indicate the reason for the request, the date and time of the upcoming hearing, and whether the opposing party is in agreement with the request. If the opposing party has not responded to your request, the motion shall so indicate. The moving party must include their complete address and telephone number on all motions. You must send a courtesy copy of the motion to the division email, divgm98@17th.flcourts.org . Filing with the Clerk of Court alone does not ensure receipt by the Magistrate. The Magistrate cannot guarantee that a motion will be reviewed and ruled upon prior to the scheduled hearing if the motion is not received at least 5 days prior to the scheduled hearing.

Florida follows the federal summary-judgment standard. The motion must be served at least 40 days before the hearing; the nonmovant's response is due no later than 20 days before the hearing.
How Florida procedural deadlines are computed: exclude the trigger day; count every day for periods of 7 days or more; for periods under 7 days, skip intermediate weekends and legal holidays; roll forward when the last day is a weekend or holiday.
Judge Siperstein requires every motion to be set within 5 days of filing and heard within 60 days, or it may be deemed abandoned.
