Applies to all matters in the 43rd and 415th District Courts and County Courts at Law Nos. 1 and 2 of Parker County. Parker registers no local rules on the TOPICs registry; this is the county-site instrument.
These local rules govern the 43rd and 415th District Courts and County Courts at Law Nos. 1 and 2 of Parker County (effective April 1, 2009, repealing all prior local rules). They set time standards (civil jury 18 months, non-jury 12; family contested 6 months, uncontested 3; juvenile deadlines; dismissal for want of prosecution under Rule 165a); rules of decorum incorporating the Texas Lawyer's Creed (suitable attire, male officers in coats and ties; no food or drink; hats removed; no ex parte contact; counsel instruct clients); the civil docket calendar (written setting requests forwarded to each Court Coordinator with a copy to opposing counsel; mediation before the Rule 166 pretrial conference; conflicts reported within 10 days of the setting notice or the setting is firm; a written trial request certifying pleadings in order, mediation and discovery status, service, jury fee and length; special exceptions and dilatory pleas set at least 30 days before trial); the district-court criminal docket (defense counsel's written notice of employment or appointment to the district attorney and clerk; arraignment, the Standard Discovery Order, pretrial under article 28.01, motions filed at least 7 days before pretrial or waived; the district attorney's monthly ready list); the County Court at Law criminal docket (notice to the county attorney and clerk; article 28.01 strictly followed; written continuance motions); civil pretrial (a Rule 166 conference within 180 days of filing and at least 21 days before trial; dilatory pleas and exceptions at least 14 days before the conference; the pretrial order controls; attendees with authority; ADR); motion practice (a certificate-of-conference and an ex parte certificate; the coordinator schedules and the movant gives written notice); trial procedure (report when called; witness and exhibit lists delivered at report; videos tendered before trial or excluded; no argument on objections before the jury); and miscellaneous provisions (withdrawal under Rule 10; final orders submitted within 20 days of the decision and temporary orders within 10; pro se parties bound by these and the state rules; dismissal after six months' inactivity with 30 days' notice; lawyers' vacation letters 45 days ahead for up to four weeks; and the court's Standing Order for parenting programs in family cases involving children, Appendix C).
