PREAMBLE: a new statutory and regulatory scheme governs all Motions for Summary Judgment ('MSJs') filed in Texas — the Act of June 2, 2025 (89th Leg., R.S., ch. 1130 / S.B. 293), the Act of August 26, 2025 (89th Leg., 2d C.S., ch. 7 / H.B. 16), Texas Government Code section 23.303, and the Supreme Court of Texas's final approval of the amendments to Rule 166a of the Texas Rules of Civil Procedure (Misc. Docket No. 96-9012) — which fundamentally alters summary-judgment practice, imposes a legislative mandate requiring judges to rule on MSJs according to the new statutory framework, and adds a reporting requirement for clerks. The undersigned Travis County Civil and Family District Courts adopt this Standing Order for all MSJs filed in their courts, setting the courts covered, the filing, notice, hearing-scheduling and submission requirements, and the deadlines by which the courts must rule under the new framework.
